These Terms of Service ("Terms") are a binding agreement between you and Embra LLC ("Embra," "we," "us," or "our") governing your use of the Zuba mobile application and the website at apps.embrallc.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Zuba is software that helps home inspectors schedule inspections, optimize routes, complete custom inspection forms, generate and deliver reports, send reminders, and request payment from their customers. We may add, change, or remove features at any time. The Service is a tool; it does not perform inspections and does not provide professional, legal, engineering, or financial advice.
The Service lets you request and accept payments from your customers through Stripe. By using these features:
You retain ownership of the content and data you create or upload ("Your Content"), including inspection notes, photos, forms, and reports. You grant Embra a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely to operate and provide the Service to you (for example, to generate reports, route your day, and send messages you request), and to create aggregated or de-identified data. We do not sell Your Content. Our handling of personal information is described in the Privacy Policy.

The Service offers AI-assisted features (e.g., drafting report prose from your notes and generating a daily route briefing) powered by third-party AI (Google Gemini). AI output may be inaccurate, incomplete, or unsuitable. You must review, edit, and approve all AI-generated content before relying on or delivering it. AI output is not professional, legal, or engineering advice, and Embra is not responsible for decisions you make based on it. Do not submit content you are not authorized to share with a third-party AI provider.
The Service relies on third-party providers (including Supabase, Stripe, Twilio, Google, Resend, WeatherAPI.com, RevenueCat, Apple, and Expo). Your use of features that depend on them may be subject to their terms, and we are not responsible for third-party services, outages, or acts/omissions.
The Service, including its software, design, branding ("Zuba"), and content (excluding Your Content), is owned by Embra and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. All rights not expressly granted are reserved.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Embra does not warrant that the Service will be uninterrupted, error-free, secure, or that data, routes, ETAs, AI output, or reports will be accurate or reliable. You use the Service at your own risk.
To the maximum extent permitted by law, Embra and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, arising out of or relating to the Service, even if advised of the possibility. Embra's total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid Embra for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You will defend, indemnify, and hold harmless Embra and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) Your Content and the data you collect, including your customers' personal information; (c) your inspections, reports, and professional services; (d) your messages to customers; or (e) your violation of these Terms or any law or third-party right.
You may stop using the Service and delete your account at any time (see the Privacy Policy, §10). We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. Sections that by their nature should survive (e.g., §§5, 6, 9, 11–14, 16) survive termination.
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, the state and federal courts located in Jefferson City, MO have exclusive jurisdiction, and you consent to venue there.
Informal resolution then arbitration. Before filing a claim, you agree to contact us at support@embrallc.com to attempt to resolve it. To the extent permitted by law, any dispute that cannot be resolved will be settled by binding individual arbitration, and you and Embra waive any right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us.
If you obtained the app from the Apple App Store, the following apply and, in case of conflict with the rest of these Terms with respect to the Apple-sourced app, control:
If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. Embra, not Google, is responsible for the app and for support. Google is not a party to these Terms and is not liable for the app.
When you enable SMS reminders, you and your customers agree that: messages are appointment-related; frequency varies; message and data rates may apply; recipients can reply STOP to opt out and HELP for help. You are responsible for obtaining each recipient's consent. Mobile opt-in data is handled as described in the Privacy Policy and is never sold or shared for marketing. See also our SMS Terms.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide notice where appropriate. Your continued use after changes take effect constitutes acceptance.
